Cost transparency right from the start
How much does the counselling / representation cost?
The question of the lawyer’s fee is usually the first and most important question, because only then can you decide whether and to what extent you want us to handle your matter. The answer can only be: It depends – on the type and scope!
The task of conducting an appeal procedure, in which the documents of two instances have to be reviewed, naturally costs more time and fees than handling a case from the outset.
The type of billing can also be chosen differently: In some cases, billing according to the RVG (Lawyers’ Fees Act), which is based on the amount in dispute, is the more favourable option, while in other cases, billing according to the actual time spent is the fairest solution. We will discuss the question of remuneration with you – however, it is also decisive whether a Spanish or German lawyer is working for you.
Remuneration according to German or Spanish fees?
The remuneration of lawyers in the Federal Republic of Germany has been regulated by the Lawyers’ Fees Act (RVG) since 1 July 2004 and is generally based on the value of the matter or amount in dispute.
In addition, remuneration agreements can also be concluded for advisory and out-of-court work, for example for a flat fee or according to time spent. Our hourly rates within the framework of individual remuneration agreements start from € 350 (plus VAT). For an initial legal consultation, we charge a standardised fee of €190 (plus VAT), as required throughout Germany.
The costs of our tax consultants are calculated separately according to the scale of fees for tax consultants. However, flat-rate fees or payment by the hour are also possible here. (250.-€ / h plus statutory VAT).
The situation is different with our Spanish colleagues. The amount of remuneration for Spanish lawyers is not fixed by law, but is agreed between the lawyer and the client. However, in accordance with Article 61 of the Spanish Lawyers’ Code (Estatuto General de la Abogacía Española) of 24 March 2021, the lawyer must comply with the Code of Conduct of the Spanish Bar (Código deontológico de la Abogacía Española) and competition rules. In the absence of an express remuneration agreement, the guidelines (baremos orientadores) of the regional bar association (Colegio de Abogados) in whose jurisdiction the lawyer is working may be used to determine the amount of the fee. A lump sum, a regular amount or an hourly rate can be agreed as a fee. It is prohibited to agree a success fee (cuota litis), according to which the lawyer receives a portion of the litigation profits as remuneration.
